1. Acceptance of These Terms

FYOP (“Find Your Own Party”, “FYOP”, “we”, “our”, or “us”) operates a campus-based community platform that helps students discover, host, and attend social gatherings (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms and Conditions (the “Terms”), our Community Guidelines, and our Privacy Policy. If you do not agree, you may not use the Service.

We may update these Terms to reflect changes to the Service or applicable laws. When we make material updates, we will notify you via the app, email, or an in-product banner. Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms.

2. Eligibility & Campus Verification

The Service is designed for verified members of supported campuses. By using FYOP, you represent and warrant that:

  • You are at least 18 years old (or the age of majority where you live).
  • You are currently enrolled, employed by, or otherwise authorized by a participating university.
  • You will provide accurate, current, and complete information during registration and verification.
  • You will promptly update your information if it changes or becomes inaccurate.
  • You have not been previously suspended or removed from FYOP for violations of our policies.

We may request additional documentation (such as a university ID or enrollment verification) to confirm your eligibility. We reserve the right to deny or revoke access at any time if we cannot verify your status or if we suspect misuse.

3. Account Registration, Security & Suspension

You are responsible for safeguarding your account credentials and for all activity occurring under your account. You agree to:

  • Create only one account per person and keep your login credentials confidential.
  • Use a valid university email address and complete any verification flows.
  • Notify us immediately at support@fyop.app if you suspect unauthorized access.
  • Not share, sell, or transfer your account or access credentials to anyone else.

We may suspend or terminate your account, remove events, or limit functionality if we believe you violated these Terms, pose a safety risk, circumvent verification, or engage in fraudulent or abusive behavior.

4. FYOP's Role

FYOP is a communications platform. We do not host, operate, or supervise events, nor do we guarantee the accuracy of event listings. Hosts create and manage events independently, and attendees decide whether to participate at their own discretion and risk. FYOP does not provide security services, venue vetting, event insurance, or emergency response.

We may provide tools (messaging, RSVPs, reminders) to facilitate logistics, but FYOP is not a party to agreements between hosts and attendees. We do not control user-generated content and are not responsible for the conduct of any user inside or outside the app.

5. Host Obligations & Event Compliance

When you create or manage an event on FYOP, you agree to the following host commitments:

  • Provide accurate, non-misleading details about the event, location, timing, capacity, and any entry requirements.
  • Ensure you have the right to use the chosen venue and that the event complies with all applicable laws, ordinances, housing rules, landlord agreements, venue policies, campus regulations, and COVID-19 or public health directives.
  • Serve as the primary point of contact for attendees and third parties (including law enforcement or campus officials) regarding safety, incidents, or complaints.
  • Maintain appropriate crowd control, security, age verification, and responsible service of alcohol (if offered) consistent with your jurisdiction's requirements.
  • Obtain and maintain any required permits, insurance, or approvals. FYOP does not procure coverage on your behalf.
  • Promptly respond to attendee questions, safety concerns, or requests for accommodation, and coordinate emergency response if needed.
  • Remove or update event listings if details change or if the event is canceled.

Ignoring these host expectations may result in the removal of your event, suspension of hosting privileges, or account termination.

6. Attendee Responsibilities & Assumption of Risk

Attending an event listed on FYOP is voluntary and at your own risk. By RSVPing or attending, you acknowledge and agree that:

  • Admission is not guaranteed. Hosts may approve, deny, or revoke RSVPs at their discretion.
  • You will follow the host's rules, campus policies, and lawful instructions while at the event.
  • You are solely responsible for your personal safety, belongings, transportation, and conduct.
  • You will not share invite-only details with unapproved individuals or encourage gatecrashing.
  • You will alert the host or authorities if you observe unsafe behavior or emergencies.

FYOP is not liable for injuries, property damage, disputes, or conflicts arising before, during, or after an event.

7. Prohibited Conduct & Content

You agree not to use the Service to engage in or facilitate behavior that is illegal, unsafe, discriminatory, or disruptive. Prohibited conduct includes, without limitation:

  • Harassment, threats, stalking, or doxxing of any person.
  • Posting content that promotes violence, self-harm, illegal drug use, underage drinking, or hate speech.
  • Encouraging dangerous stunts, hazing, sexual exploitation, or trafficking.
  • Sharing another person's private information without consent.
  • Using automated tools, scrapers, or bots to access the Service.
  • Attempting to compromise platform security, inject malware, or disrupt operations.
  • Commercializing the Service without written permission (including selling guest lists or advertising unrelated products).
  • Infringing others' intellectual property or misrepresenting your affiliation.

Violations may result in content removal, account restrictions, or referral to campus or law-enforcement authorities.

8. User Content & License Grant

You retain ownership of content you submit to the Service (“User Content”). By posting User Content, you grant FYOP a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify, adapt, publish, translate, distribute, and display that content for the purposes of operating, improving, and promoting the Service.

You represent that you have all necessary rights to share the User Content and that it does not infringe or violate any third-party rights or laws. We may remove or disable access to content we believe violates these Terms or applicable law.

9. Messaging & Communication Tools

The Service includes messaging, announcements, and notifications. By using these features, you agree to communicate respectfully, avoid spam, and follow campus policies. FYOP may monitor or retain communications as permitted by law to enforce policies, investigate incidents, or comply with legal requests.

Hosts are responsible for monitoring their event chats, removing disruptive participants, and escalating urgent safety concerns to authorities when appropriate.

10. Safety, Incident Response & Reporting

FYOP encourages proactive safety planning. If you witness or experience an emergency, contact local authorities immediately. After an incident, you may report it to FYOP so we can review the account and take action if necessary. We may cooperate with law enforcement, universities, or other authorities consistent with our Privacy Policy.

Hosts agree to document material incidents, cooperate with investigations, and notify FYOP of serious safety concerns (including medical emergencies, violence, or property damage) within a reasonable time.

11. Fees & Payments

FYOP may introduce premium features, ticketing tools, or other paid offerings in the future. We will disclose any fees before you incur them. Unless otherwise stated, all payments are non-refundable except as required by law. You remain responsible for any payment-processing fees charged by third-party providers.

12. Intellectual Property

FYOP owns or licenses all right, title, and interest in the Service, including our trademarks, logos, designs, text, graphics, and software (excluding User Content). You may not copy, modify, reverse engineer, distribute, or exploit the Service without our prior written consent.

13. Privacy & Data Use

Our data practices are described in the FYOP Privacy Policy, which is incorporated into these Terms by reference. We collect and use information to operate the Service, verify campus affiliation, promote safety, personalize experiences, and comply with legal obligations. Hosts may receive limited attendee information necessary to manage their events.

14. Third-Party Services & Integrations

The Service may link to or integrate with third-party tools (such as payment processors, ticketing services, mapping providers, or messaging platforms). FYOP does not control these third parties and is not responsible for their content, policies, or actions. Your interactions with third-party services are governed by their own terms and privacy policies.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FYOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT EVENTS WILL MEET YOUR EXPECTATIONS.

FYOP does not conduct background checks on users and does not guarantee the identity or conduct of hosts or attendees.

16. Assumption of Risk & Release

You acknowledge that participation in social gatherings carries inherent risks, including but not limited to bodily injury, illness, property damage, theft, harassment, or exposure to intoxicants. By using FYOP or attending events discovered through the Service, you voluntarily assume all such risks.

To the fullest extent permitted by law, you release FYOP and its affiliates, officers, directors, employees, and agents from any claims, demands, damages, liabilities, or causes of action arising out of or relating to events you host or attend, except to the extent directly caused by FYOP's intentional misconduct.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYOP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL FYOP'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO FYOP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

18. Indemnification

You agree to indemnify, defend, and hold harmless FYOP and its affiliates, officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the Service.
  • Events you create, promote, or attend through FYOP.
  • Your User Content or communications.
  • Your violation of these Terms, campus policies, or applicable law.
  • Your infringement or misappropriation of any third-party right.

Hosts specifically agree to defend and indemnify FYOP against any claims brought by attendees, neighbors, venues, or authorities related to their events.

19. Insurance & Risk Allocation

FYOP does not provide insurance for hosts or attendees. We strongly encourage hosts to maintain comprehensive general liability insurance, personal liability coverage, or tenant insurance sufficient to cover their events. If you choose to host without insurance, you do so at your own risk and remain fully responsible for resulting losses or claims.

FYOP may require proof of insurance for certain events or hosting tiers and may suspend or remove events that do not satisfy risk requirements.

20. Termination & Suspension

20.1 By You

You may delete your account at any time in the app or by emailing support@fyop.app. Account deletion is permanent and subject to our data-retention obligations described in the Privacy Policy.

20.2 By FYOP

We may suspend or terminate your access immediately, with or without notice, if we determine that you violated these Terms, pose a safety risk, fail verification, engage in fraud, or otherwise harm the community. We may also remove events or restrict features at our discretion.

20.3 Survival

Sections that by their nature should survive termination (including intellectual property, indemnification, limitation of liability, dispute resolution, and risk allocation provisions) will remain in effect.

21. Dispute Resolution

21.1 Informal Process

Before filing a claim, you agree to contact FYOP at legal@fyop.app and attempt to resolve the dispute informally for at least 30 days.

21.2 Binding Arbitration

If the dispute is not resolved informally, it shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place on an individual basis; class actions and class arbitrations are not permitted. You and FYOP waive the right to a jury trial.

21.3 Exceptions

Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or to enforce confidentiality obligations.

22. Governing Law & Venue

These Terms and any disputes arising out of or relating to them are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law principles. Subject to the arbitration agreement above, the exclusive venue for litigation arising from the Terms is the state or federal courts located in Wilmington, Delaware.

23. Miscellaneous

23.1 Entire Agreement

These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and FYOP concerning the Service.

23.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

23.3 No Waiver

Our failure to enforce any provision shall not be deemed a waiver of that provision or any other provision.

23.4 Assignment

You may not assign or transfer these Terms without our prior written consent. FYOP may assign these Terms without restriction.

23.5 Third-Party Beneficiaries

Except as expressly provided, these Terms do not create rights for third-party beneficiaries.

Important Notice

By using FYOP, you acknowledge that you have read and understood these Terms, including the risk allocation, insurance expectations, and arbitration provisions. If you do not agree, you must stop using the Service immediately. Updates to these Terms take effect when posted unless we specify otherwise.
